SWAT Team Removes Squatters From Foreclosed Home

In Naples, Florida, a group of squatters moved into a foreclosed home that was empty. The Naples Police Department called in a SWAT team in March of 2011. The SWAT team gassed the foreclosed home to try to force the squatters out. Three adults and two children were removed from the home. The two children, ages 2 and 3, were taken by the Florida Department of Children and Families.

A neighbor who was interviewed by NBC news said, “it makes me so sad, it gives me chills. This is a quiet neighborhood. This is the only house we have here that’s in foreclosure.”

Federal Government Getting Out of the Mortgage Business

Fannie Mae and Freddie Mac were created by the Federal Government to assist homeowners in obtaining mortgages to purchase single family and/or multiple family homes. Freddie Mac and Fannie Mae are not doing well. They are both bankrupt. These organizations are currently being bailed out by the Federal Government.

President Obama and his administration would like to abolish Fannie Mae and Freddie Mac. Both the White House and Congress are in agreement that the long term future of the mortgage market should be determined by private enterprise and not by federally backed agencies.

Today, tax payers are shelling out billions of dollars to keep Freddie Mac and Fannie Mae financially solvent. These organizations are involved in almost 90% of all mortgages in the United States. Freddie Mac and Fannie Mae buy mortgage loans from primary lenders (banks). They put them together in investment products and sell them with guarantees in the event the borrower defaults. The initial purpose of Freddie Mac and Fannie Mae was to facilitate the purchase of homes by middle class Americans. The underlying reason for their creation was to allow more Americans to obtain the American dream, the ownership of a single family home at an affordable mortgage rate.

Three Proposals for the replacement of Freddie Mac and Fannie Mae

Proposal 1: The Federal Government would not be involved in the underwriting of home mortgages. The Federal Housing Administration would simply police mortgage activities.

Proposal 2: The Government would act as an insurer of mortgages.

Proposal 3: The Government would act as an insurer of only targeted mortgages. Under this proposal, the government would be involved more as a reinsurer of mortgages.

Congress and the Obama Administration are now discussing these proposals.

Sometimes the mortgage scam companies request the mortgage holder to make their payments to them and not to their financial institution. They claim they will take care of the problem at their end. Decimated Home ValuesDuring the last three months of 2010, home values nationwide went down 2.6%. As home values have gone down, foreclosures have increased. The more homes foreclosed and brought onto the market, the greater the over-supply of inventory. In a supply and demand based market place, the greater the supply without a corresponding increase of demand will lead to a continual reduction in the value of homes in the United States.

Wells Fargo Faces Penalties in Foreclosure

Wells Fargo Faces Penalties In ForeclosureWells Fargo is currently being investigated by various governmental agencies with regard to illegal practices concerning mortgages and foreclosures. Wells Fargo has been accused of violating fair lending laws by the Security and Exchange Commission.

The company spokesman for Wells Fargo recently stated “with regard to the investigation into foreclosure practices, it is likely that one or more of the government enforcement actions against Wells Fargo will result in civil monetary penalties.” There are also more than half a dozen class action lawsuits pending against Wells Fargo on behalf of homeowners. These lawsuits claim that employees at Wells Fargo executed documents in foreclosure proceedings without having personal knowledge of the facts contained in these documents. The relief requested in the lawsuits against Wells Fargo asks for monitory damages, cancellation of mortgages and other penalties against the bank. Wells Fargo has indicated that they make be facing as much as $1.2 billion dollars in losses related to the pending litigation. This has caused the bank’s share price to go down.

In 2010, One Million Homes Foreclosed and Repossessed in the United States

2010 was the worst year in modern history with regard to homes being foreclosed on in the United States. One million American families were forced out of their homes. It is estimated that we will break this horrendous record in the year 2011 and more than a million families will be forced out of their homes due to foreclosures.

It is estimated that more than five million mortgage holders are more than two months behind in their mortgage. Unless more jobs are created by the Obama administration, it is expected that more Americans will lose their jobs in 2011. As foreclosures increase, the home values in the areas with high levels of foreclosures decrease.

2.9 million homeowners received foreclosure filing notices in 2010. This amounts to virtually one in every forty-five homeowners receiving a foreclosure notice. In December alone, more than a quarter of a million homeowners in the United States received a foreclosure notice. As incredible as this sounds, this is good news! This is the lowest amount of foreclosure notices in the past thirty months. The reduction in foreclosure notices was caused by banks reviewing their foreclosure processes after there were numerous instances where it was found that evictions and foreclosure documents were being inappropriately handled by financial institutions. There has also been lawsuits by the Attorney Generals in all fifty states that have put banks under greater scrutiny regarding their practices concerning foreclosing on homes.

Arizona was the leader in 2010 in foreclosures. One in every seventeen households in Arizona received a foreclosure notice. Florida came in second. One out of every eighteen homeowners in Florida received a foreclosure notice. Approximately fifty-percent of the foreclosure notices in the United States were in the five states of California, Illinois, Arizona, Michigan and Florida.

Suffolk County on Long Island had the highest foreclosure rate in New York State in the year 2010. Although the foreclosure rates in New York are lower than many other states, they are still extremely high by traditional standards. Foreclosure Crisis: A Problem for President Obama & the Democrats

The foreclosure crisis in the United States is now reaching the highest office of the land. President Obama is being backed into a corner, forced to protect the banking industry from allegations of fraud, misrepresentations, improper lending practices, defective foreclosure lawsuits and predatory lending issues.

Senior democrats have been calling for a moratorium on foreclosures in the United States. They seek to punish the banking industry for their improper actions.

Recently, Shaun Donovan, the Secretary of Housing and Urban Development, made the following statement: “irresponsible banks need to be held accountable, but if we have not found a problem with a bank’s process, we do not believe that we should impose a moratorium that can hurt the market and hurt the individual buyers.”

The Obama Administration has taken the position that if we hurt or damage the financial industry, in the long run, it is the public who feels the pain when the economy continues to erode.

The banking industry is arguing against the moratorium on foreclosures. They claim that the moratorium would have a long term negative effect on the economy in the United States. The Obama administration shares this concern. Recently, David Axelrod, a senior White House advisor, stated “There are in fact valid foreclosures that probably should go forward.” The Obama administration’s position is that people who don’t pay their mortgages should be held accountable in foreclosure proceedings. In the alternative, homeowner advocates claim there has been a pattern of abuse in the banking industry regarding foreclosures. The Obama administration wants to play this issue both ways. They are expressing concern for homeowners’ whose homes are in foreclosure, but they do not want to take any steps that may have a negative affect on the banking industry because they feel it will have long term negative economic impact in the United States.
